2. Who These Terms Apply To
These Terms apply to all customers, senders, consignees and their agents who engage us for freight and logistics services, whether acting for personal, domestic or commercial purposes. Where you engage us on behalf of a business or other entity, you confirm that you are authorised to do so and that these Terms bind that entity.

Details of our current service offering are described on our Services page. The specific scope, route and inclusions of each engagement are set out in your quote or booking confirmation.
4. Quotes, Bookings and Payment
4.1 Quotes are based on the information you provide, including freight type, dimensions, weight, and pick-up and delivery locations. Quotes are valid for 14 days from the date of issue unless otherwise stated in writing.
4.2 Final charges may vary where the actual details of the consignment differ from the information supplied at the time of quoting, including where additional handling, waiting time or re-delivery is required.
4.3 A booking is confirmed only once we have accepted it in writing, including by email.
4.4 All prices are quoted in Australian dollars and include GST where applicable. Unless otherwise agreed in writing, invoices are payable within 14 days of the invoice date by the payment method stated on the invoice.
4.5 Overdue amounts may, to the extent permitted by law, attract reasonable administrative costs associated with recovery.
5. Your Obligations
5.1 You warrant that you own the goods or are otherwise authorised by the owner to consign them for carriage.
5.2 You must provide accurate and complete information about your freight, including its nature, weight, dimensions, packaging and any special handling requirements.
5.3 You must ensure goods are packed, labelled and secured appropriately for transport and comply with all applicable laws and regulations relating to their carriage.
5.4 You must ensure reasonable and safe access at the pick-up and delivery locations, including suitable loading and unloading facilities where required.
6. Pick-up, Transit and Delivery
6.1 Pick-up windows, transit times and delivery estimates provided by us are estimates only and are not guaranteed. We will provide reasonable updates on the status of your consignment on request.
6.2 If the consignee is not available to receive the goods at the agreed delivery point, additional re-delivery, storage or waiting-time charges may apply.
6.3 Delivery is taken to be completed when goods are left at the agreed delivery address, signed for by a person reasonably believed to be authorised to receive them, or otherwise dealt with in accordance with your written instructions.
7. Dangerous and Restricted Goods
7.1 Dangerous goods, hazardous substances, perishables, firearms, illicit items and other restricted goods must be declared to us in writing before a booking is confirmed. Some items may be refused carriage at our discretion.
7.2 If you consign dangerous or restricted goods without declaration, you are responsible for all resulting loss, damage, fines, penalties and costs arising from that carriage, to the extent permitted by law.
8. Liability and the Australian Consumer Law
8.1 Nothing in these Terms excludes, restricts or modifies, or purports to exclude, restrict or modify, any consumer guarantees, rights or remedies that cannot be excluded under the Australian Consumer Law set out in Schedule 2 of the Competition and Consumer Act 2010 (Cth), or any other rights you may have under applicable Commonwealth, State or Territory legislation.
8.2 Where our services are not of a kind ordinarily acquired for personal, domestic or household use or consumption, our liability for a failure to comply with a consumer guarantee that cannot be excluded is limited, to the extent permitted by law and at our option, to supplying the services again or paying the cost of having the services supplied again.
8.3 Subject to sections 8.1 and 8.2, and to the maximum extent permitted by law: (a) we are not liable for any indirect, incidental, special or consequential loss, including loss of profits, loss of business opportunity or loss of data; and (b) our total aggregate liability arising out of or in connection with any particular booking is limited to the amount you paid to us for that booking.
9. Insurance and Risk
9.1 Unless we agree otherwise in writing, goods are carried at the owner’s risk to the extent permitted by applicable legislation.
9.2 Transit insurance may be arranged on request at additional cost. Please advise us before booking if you require insurance cover for your consignment.
10. Cancellations, Variations and Refunds
10.1 You may cancel or vary a booking by contacting us by email at ceo@bawalogistics.online. Reasonable cancellation or variation fees may apply where a vehicle has been dispatched, loading has commenced, or costs have already been incurred.
10.2 Variations to freight details, routes or schedules may result in an adjusted price, which will be confirmed to you in writing before it takes effect.
10.3 Where a refund is due, it will be processed by the original payment method within a reasonable time.
